有關何君堯「殺無赦」論

Law-maker Junius Ho's Call for "Killing without Mercy" (Please scroll down for English summary)

兩日前鄉事派曾樹和公開謂攪港獨人士須「殺」,立會議員何君堯即時附和曰:「無赦···呢啲人唔殺咗佢做咩?」反對派議員及市民紛紛譴責何君刑事恐嚇或煽動殺人,甚至報警。何君堯今早引柳宗元文〈駁復仇議〉,在面書辯稱殺無赦指「殺人者罪不得赦」。然港獨派並無殺人,而綜觀何氏當日言論上文下理及說話語氣態度,都在在強調要毫不留情,殺港獨人士。查四書五經,傳統小說,殺無赦的意思亦係誅殺不留情之意。何君堯又謂要港獨即是要戰爭,戰時殺敵無問題,言則,香人大經宣佈香港進入戰爭狀態?以下筆者以漢學家身份,引經典原文,詳細分析何君堯的語義謬誤。

柳宗元《駁復仇議》「臣伏見天後時,有同州下邽人徐元慶者,父爽為縣吏趙師韞所殺,卒能手刃父仇,束身歸罪。當時諫臣陳子昂建議誅之而旌其閭;且請編之於令,永為國典。臣竊獨過之。 臣聞禮之大本,以防亂也。若曰無為賊虐,凡為子者殺無赦。」意即如果要防止賊人肆虐,即使為報父仇而殺人亦不可赦免。然而,而今講港獨的人殺了人嗎?而且,須看何君堯說話的上文下理。曾樹和首先話攪港獨的外來人士必須要殺,何君堯緊接殺字,高呼「無赦」,即是要毫不留情誅殺講港獨人士,其後更補充,「如果攪港獨···呢啲人唔殺咗佢做咩?」

至於有人為何君堯辯解,話平民無權赦免犯了死罪之人,何君堯只係要求港共政府對港獨派殺無赦而已。然而,何君堯講殺無赦時,根本無提到政府呀!其後其本人的補充解釋亦都無提到政府啊!

查四書五經,傳統白話小說,殺無赦的意思都係誅殺而不留情赦免之義。例如,

《禮記.檀弓下》:臣弒君,凡在官者殺無赦;子弒父,凡在宮者殺無赦。殺其人,壞其室,洿其宮而豬焉。《尚書·胤征》:《政典》曰:『先時者殺無赦,不及時者殺無赦。』《禮記.君道》:《書》曰:「先時者殺無赦,不逮時者殺無赦。」《太平御覽》:《禮記》...又曰:作奇伎淫巧以蕩上心者,殺無赦。《封神演義》:妲己上前跪而奏曰:「...故凡妖言惑眾者,殺無赦!」

此外,何君堯十八日接受媒體訪問提到,「要求到要港獨的時候,即是要戰爭啦,戰爭裏面殺敵人有什麼問題啊?」按何君堯的講法,香港如今有人提出港獨,即是要戰爭,在戰場上殺敵無問題,言則,全國人大常委會宣布了香港進入戰爭狀態嗎?基本法第十八條訂明,全國人大常委會決定宣布戰爭狀態,或因香港內發生香港政府不能控制的危及國家統一或安全的動亂,而決定香港進入緊急狀態,中央人民政府可發布命令將有關全國性法律在香港實施。

何君堯面書又話「『殺』有慣用於:殺校(關閉學校),殺科(完結),殺晒(全勝),殺出血路(創出名堂),殺個措手不及(突襲成功),殺個你死我活(鬥得厲害),殺人不見血(手斷高超),師奶殺手(萬人迷)」,聲稱這些表述絕非鼓吹別人犯法,而是「抵死啜核的港式用詞」。然而,正如前述,殺無赦的意思要睇上文下理及說話語氣態度,而且殺無赦的殺常指殺人;殺校、殺科則並非殺人;而殺人不見血則係套語,有特定意義,不會誤解為真正持刀揸槍殺人。

九月十七日立法會議員何君堯在添馬公園舉行「革走戴耀廷吶喊大會」,屏山鄉鄉事委員會主席曾樹和上台發言時,香港憑什麼港獨,無槍又無炮,攪港獨者若不認自己是中國人,就是外來人士,必須要「殺!」何君堯亦附和高呼「無赦」。何君堯其後回應道「睇吓殺咩啦,殺豬殺狗唔係咩一回事」,更補充:「如果搞港獨嘅人將成個國家命運顛覆,要令香港及祖國十三億人付出龐大代價,呢啲人唔殺咗佢做咩?」何君堯十八日接受媒體訪問提到,「要求到要港獨的時候,即是要戰爭啦,戰爭裏面殺敵人有什麼問題啊?」十九日凌晨何君堯於面書又引用柳宗元《駁復仇議》,解釋「殺無赦」:「那並非指要殺人,而是指『殺人者罪不得赦』。

At an anti-independence rally last Sunday, rural leader Tsang Shu-wo said that pro-Hong Kong independence people should be “saat3殺killed” with law-maker Junius Ho shouting “mou4 se3無赦without mercy” in response. Ho then asked, "Why shouldn't these people be killed?" Consequently, many opposition law-makers and civilians condemned Ho for criminal intimidation and some of them even reported to the police. This morning, Ho, on his facebook, in citing Tang Dynasty writer, Lau Zung-juen's (773-819) essay "bok3 fuk6 sau4 ji5駁復仇議 (Retorting the Theory of Revenge)", explained that "no mercy" referred to "no murderers should be pardoned".

However, no pro-independence elements in HK have murdered anybody. And both the context of Junius Ho's speech and his tone and attitude then suggested that he was stressing that pro-independence people in HK should be killed without mercy. In fact, when we check out Chinese classics other than Lau's essay aforementioned, we will notice that "saat3mou4se3殺無赦"always means "to kill without mercy." For example, in Book of Rites, we have,  "When a minister kills his ruler, all who are in office with him should kill him without mercy (臣弒君,凡在官者殺無赦)." Junius Ho also asserted on his facebook this morning that to advocate independence is to ask for war, and it is alright to kill enemies during wartimes. But has the National People's Congress announced that Hong Kong is at war?
